COPYRIGHTS AND TRADEMARKS

A copyright is a bundle of exclusive rights in a creative work. The rights included in a copyright are:

1. the right to make copies of the work;
2. the right to distribute copies of the work to the public (i.e. to publish the work);
3. the right to perform the work publicly;
4. the right to display the work publicly; and
5. the right to prepare other works based on or derived from the work.

The owner of a copyright has the exclusive right to exercise or authorize another to exercise any of the rights contained in the copyright, and any exercise of any of the rights in a copyright without the permission of the copyright owner constitutes copyright infringement.

A trademark is any word, name, logo, design or other element that is used to identify the goods of a particular source and that distinguishes those goods from the goods of another source. Rights in a trademark are acquired by the actual use of the mark on goods in commerce. The use by another person of the same mark or a similar mark in any manner that is likely to confuse the public into believing that the other person's goods are produced, endorsed or sponsored by or affiliated with the trademark owner constitutes trademark infringement.
